Tracy Jong is registered to practice before the United States Patent and Trademark Office (USPTO) (Registration No.: 56105), the Western District and Southern District of New York (federal court) and the State Bar of New York. In addition to a doctorate of law, Tracy has scientific and technical training in the chemical arts as well as many years of private legal practice and government experience. Tracy is active in all two core practice areas of the firm: Intellectual Property and Restaurant, Winery & Liquor Law.

Intellectual Property

Tracy concentrates her practice on client counseling, US and foreign patent and trademark preparation and prosecution, copyright procurement, licensing and technology transfer and exploitation. With her network of specialists and patent agents, she is able to serve inventors in a wide variety of disciplines and technical arts. As an experienced IP attorney, Tracy works with clients to create a protection strategy that makes the most of their money.

Tracy represents individuals, businesses and not-for-profits in wide variety of technology protection subject matter – licensing, technology transfer, confidentiality, non-competes, joint ventures, and other agreements; trade secret protection strategies; IP inventories and organizational IP policies; copyright registration; technology-related consulting and strategy development (“cradle to grave”) for start-ups, entrepreneurs, students, faculty and small to mid-sized businesses to commercialize and protect ideas; and pre-litigation IP enforcement.

Partnering with clients in decision making process and educating them about legal options is Tracy’s private practice business model. She is actively involved in educating laypersons, inventors, consultants and other attorneys about issues in patent and trademark law through several bar associations and professional organizations, the Rochester Public Library (a local USPTO Depository Library), other local libraries, and as a business accelerator speaker and local college and high school class and event speaker. Tracy is an instructor and author for PDHengineer, which provides online continuing education courses for professional engineers in several areas of patent and IP law.

Restaurant, Winery & Liquor Law

By serving restaurant, winery and microbrewery owners, Tracy marries her passion for good food and wine with her commitment to educating business owners to make informed, cost-effective decisions and strategies. Tracy has previous experience in management consulting for Fortune 500 companies at Moran, Stahl & Boyer in midtown Manhattan and managing a public power company and municipal government in western New York. Tracy is able to draw from these experiences when working with new business owners to create strong, stable business practices that lead to success. She brings practical solutions to challenges that face these business owners. By understanding the industry dynamics, creative approaches to both common and unique situations are crafted. Tracy helps entrepreneurial spirits enter this new industry and business owners to maximize their return when they sell.

Growing up in an agricultural community, Tracy understands some of the issues facing agricultural-based businesses – seasonal economics, immigration issues, multi-generation family-owned business entities, branding protection, land use regulations and food and alcohol regulations. Blended with tourism and alcoholic beverage regulation, businesses like wineries can have complex issues that require a multi-faceted expertise.

Food and beverage businesses’ largest asset is generally their good will and trade secrets – their good reputation and earning potential. With an expertise in intellectual property, Tracy can help these businesses to protect their brand, their trade secrets and their competitive advantage in the marketplace. This is the key to building long-term equity value in the business.

The TTB and New York State Liquor Authority can be complex agencies to navigate. Tracy assists businesses in the licensing and renewal process, labeling and federal licensing issues, and representing them in violations/suspension cases before the State Liquor Authority.

Tracy is active in the legal and greater Rochester communities. She is a regular presenter at numerous Bar Association seminars on patent and intellectual property law, including the recent America Invents Act and its impact on the U.S. patent application process. She has also offered intellectual property-related courses through Rochester Public Library, Rochester Info-Courses and other venues to provide useful information to the general public interested in protecting the assets. Tracy has written several PDH courses on topics such as patent searches, strategies with prior art, and the new patent laws.

Tracy is also an active member of the American, New York, and Monroe County Bar Associations, the Rochester Professional Consultants Group, the Greater Rochester Area Women’s Bar Association, and the Rochester Intellectual Property Law Association. Her current volunteer work aids three Rochester area not for profit organizations: Rochester Greenovation, Invention Convention and E2 Edible Expo. She is also active on the Parent Board of Fallone’s Fun Time Center.

With a practice focused on independent and small businesses, Tracy strives to develop practical and cost-effective strategies based on the business objectives of her clients. She believes that information is power and that informed decisions can only be made when you have all of the useful information available. The focus of Mr. Jong's patent practice before the USPTO is in patent preparation and prosecution, starting from boiling down each client's invention into its essence to securing the broadest possible claims for my clients based on their commercial goals. Mr. Jong is a strong believer in educating his clients in the patenting process so that he can spur the creation of new concepts and embodiments never considered before. Mr. Jong's approach often results in patent clients leaving his office with a wealth of knowledge about patenting in general and more specifically in the materials expected of them from his office. Mr. Jong is a Registered U.S. Patent Agent (Registration No.: 56551) and also a licensed Professional Engineer (Registration No.: 083586) in the state of New York. Mr. Jong is also the founder/owner of PatentSlice.com, an automated service that helps casual patent readers and patent practitioners alike, in more quickly grasping and analyzing the concepts of existing inventions and also your own patent drafts.

While a Shell scholar, Mr. Jong studied engineering and earned his B.S. (with high scholastic honor) in Engineering with Mechanical Specialty in 1994 from the Colorado School of Mines. He continued on to earn his M.S. in Engineering Systems in 1996 from the same university. While completing his master’s degree, Mr. Jong taught Fluid Mechanics laboratory classes. While consulting at Caterpillar, Inc., he was involved in designing, developing and testing automated digging (autodig), hydraulic control software and valve controls systems for 980G wheel loaders, R1700 Load Haul Dump(LHD)s and independent metering valves. Before joining Xerox Corporation, Mr. Jong was responsible for designing and developing valve actuator and pipeline safety equipment as well as managing an offshore oil and gas platform valve actuator retrofit project with Rotork Fluid Systems. While at Xerox Corporation, he was a key machine control software developer in areas of fuser, raster output scanner, xerography, communication and printer controller tester. In addition to assisting clients in patent matters, Mr. Jong also helps bridge technical and cultural gaps between U.S. companies and their Chinese business counterparts.

Louis Reale is registered to practice before the United States Patent and Trademark Office as a patent agent. He is a proficient innovator and product developer who holds over 12 US and foreign Patents. He has extensive experience in evolving newly discovered innovations into mature products. Innovations and experience are in the areas of material science, imaging science, sensors, electrostatics/electronics technology, plasma science, and novel industrial manufacturing processes. Technology transfer of innovations/products has led to participation in worldwide implementation teams in USA, Europe, Brazil, and Japan. He has also held R&D Principal position at Med Graph, Inc.

Louis has earned several awards of appreciation in the areas of technical discovery and implementation including the two most prestigious awards bestowed by the Xerox Corporation: The Individual Excellence Award for Innovation, and the President's Award. He holds undergraduate degrees in Electrical Engineering, a Masters in Engineering, and a Graduate certificate in Quality from Rochester Institute of Technology. Louis is VP of the Inventor's Society of Western New York, an organization designed to guide young entrepreneurs.

Julie joined the restaurant, bar & club team in assisting clients with their liquor licensing applications after successfully assisting Tracy Jong Law Firm in business development. Julie comes to us with a B.S. degree in Business Management with a concentration on digital marketing and graphic design. She joined our firm back in 2013 and is in charge of business development projects, marketing, and graphic design needs of the Firm. Julie also acts as our liaison between customers and our legal team making sure that the lines of communication remain open and ensure that quality and service exceed client expectations. The service we provide to our clients is of utmost importance and Julie strives to build trust and strong long term relationships with our clients. Some of Julie’s greatest strengths are her positive attitude, customer service experience, organizational and technological skills. On the weekends she enjoys assisting with the design needs of a company she co-founded, Creative BluePrint Marketing & Design. Her company assists small businesses with their marketing and graphic design needs across the United States.

Chris is a paralegal primarily responsible for business formation and intellectual property matters. He strives to consistently achieve more efficient and higher quality results for our clients. Chris received his Bachelor of Arts in Psychology at SUNY Geneseo in May 2011 and began his career as a business immigration paralegal with a specialization in PERM labor certification. His case management and prioritization skills have facilitated his transition into Tracy Jong Law Firm and have allowed him to become a strong contributor to our practice. During his free time, Chris enjoys playing tennis, running and spending time with family and friends. He is a fan of the New York Yankees, Giants, Knicks and Rangers.

Joe has been in the nightclub and bar industry for over 20 years, even managed and owned a couple as well. He has been working with community boards and city halls in securing license approvals for clubs, bars, cabaret licenses, fire department PA approvals and police departments. Joe's experience ranges from not only club and bar operations startup and daily procedures but to cash procedures and loss prevention protocols as well. His Liquor License preparations skills are focused on the perspective that he was a bar owner and felt the need to have his licenses done properly and fast to open and sell to make profits. He dedicates his services with the principal to treat all clients with the same desire as he had.

Barbara holds a B.S. degree in Organizational Management and joins the team with strong office and customer service skills that have improved the performance of the various teams with whom she has worked. Her background of nursing, direct sales, marketing, team building, real estate transactions and office management helps the team offer a well-rounded contact point at the Firm. Her duties include accounts payable, bookkeeping, and human resources. During her free time, Barbara enjoys working with small business Hospitality clients in the Golf industry and is a team lead for an upstate NY specialty marketing team for the same. Quieter moments will find her reading, hiking the Finger Lakes Trail and Greenway with her husband and dogs, and cooking with her children.
